An official default assessment (liquidación de aforo) is the administrative act through which DIAN unilaterally determines the substantive tax liability of a taxpayer, withholding agent, or entity that has completely omitted filing tax returns. Governed by Articles 715 to 719 of the Colombian Tax Statute, this authority does not operate automatically: statutory law imposes mandatory exhaustion of prior procedural steps under Articles 715 and 716. First, DIAN must issue a formal prior summons to file (emplazamiento previo por no declarar, Article 715), having substantiated the underlying obligation, granting an unextendable one (1) month deadline to file. Taxpayers filing within this month must compute late-filing penalties under Article 642 E.T. If the month expires without a filed return, DIAN applies the failure-to-file penalty under Article 643 E.T. Only upon strictly exhausting these preliminary proceedings does Article 717 empower DIAN to determine tax liability through a default assessment within five (5) years following the original statutory filing deadline.
The default assessment must strictly satisfy the content requirements of Article 719, cross-referencing Article 712: identification of the taxpayer, tax period, quantification bases, tax and penalty amounts, official signature, and a summary explanation of the grounds for the assessment. Pursuant to Articles 719-1 and 719-2, once the assessment is notified, DIAN orders its inscription in public property registries, creating a statutory real encumbrance (garantía real) over the taxpayer's assets enforceable even against third-party transferees. This lien may only be lifted upon full debt extinction, revocation or annulment of the act, posting a bank guarantee or insurance bond, or offering sufficient real property for attachment. Against the liquidación de aforo, taxpayers may file a reconsideration appeal (recurso de reconsideración, Article 720 E.T.) within two (2) months of notification before DIAN; upon exhausting the administrative channel, judicial annulment proceedings become available. Under Article 640 E.T., statutory penalty reductions require that DIAN has not yet issued a prior summons to file, making pre-summons intervention paramount.
