Enforced Collection · DIAN Payment Order

DIAN payment order:
defense with the reference tax-law firm in Colombia.

If DIAN served a payment order (mandamiento de pago), understand this first: within enforced collection (cobro coactivo), it is the coercive order to settle a debt backed by an executable title under Article 828 of Colombia's Tax Statute, plus inflation adjustments and late-payment interest. You have a strict deadline of 15 business days to file exceptions, which form an exhaustive closed list under Article 831 and do not permit reopening substantive tax disputes if the underlying title is already final. Ignoring it triggers an execution order, bank asset freezes, and auctions. Ligal is the reference tax-law firm in Colombia: led by Juan Santiago Rodríguez Prieto, ex-DIAN tax attorney and director, supported by certified public accountants from LIGAL Auditores, handling real enforced collection and audit cases, holding a verified 5.0/5 rating on Google across 28 reviews.

Legal Nature & Consequences

A coercive payment order, not a persuasive reminder.

Apayment order (mandamiento de pago) is the administrative act through which DIAN formally initiates enforced administrative collection (Article 826 of the Tax Statute). It is neither a friendly payment reminder nor an ordinary inquiry: it is a coercive writ demanding payment of tax obligations based on executive titles defined in Article 828 (self-assessed returns, final official assessments, definitive penalty resolutions, bonds, or court rulings). The order demands full payment of principal taxes, withholdings, and statutory penalties, alongside monetary adjustments and default interest accrued up to actual payment.

Once served, the debtor has exactly fifteen (15) business days to either settle the liability or submit written legal exceptions under the closed, exhaustive list of Article 831 of the Tax Statute. These exceptions are strictly restricted to: full payment, existence of a payment agreement, lack of enforceability of the title, loss of enforceability due to revocation or judicial suspension, statute of limitations (Article 817), lack of an executive title or incompetence of the issuing official, and improper joint debtor designation. If the title is legally final, the payment order does not allow a renewed debate on deductions or tax methodology. If ignored within 15 days, Article 836 mandates an order to proceed with execution, ordering asset attachments, seizures, appraisals, and auctions.

Critical Assessment Points

  • Exact service date and calculation of the 15 business days.
  • Executive title validity: self-assessment, official assessment, or penalty resolution (art. 828).
  • Verification of enforceability, 5-year statute of limitations (art. 817), or uncredited payments.
  • Prior or simultaneous asset attachments on accounts and property (art. 837).

Technical Strategy

From service to halting collection.

Defense against a payment order is won through executive title audits and timely, rigorous statutory exceptions.

01

Executive title audit

We review whether the document invoked by DIAN meets Article 828 criteria: whether it is legally final, if defective service occurred, or if collection relies on suspended acts.

02

Statute of limitations and payment reconciliation

We examine the 5-year collection limitation period under Article 817 and reconcile uncredited tax vouchers and withholding balances against DIAN's ledgers.

03

Article 831 exceptions brief

We draft and file the admissible exceptions within the mandatory 15-business-day window. If rejected, we lodge the statutory appeal (reposición) under Article 834.

04

Precautionary measure defense & payment agreements

If the debt is final and undisputed, we negotiate a formal payment agreement under Article 814 to lift bank seizures and avert asset auctions.

Clear Boundaries

What we do not do in payment order defense.

We do not raise invalid extra-legal arguments

Article 831 sets an exhaustive closed list. Irrelevant or dilatory claims result in immediate dismissal by DIAN.

We do not miss the 15-business-day deadline

Deadlines are statutory and final. Missing the window compels DIAN to order mandatory asset attachment and public auction.

We do not promise to reopen settled tax issues

If an official assessment became final because prior appeals were omitted, the payment order cannot reopen substantive tax merits.

The Advantage

Understanding enforced collection from inside DIAN.

In enforced administrative collection, the tax authority acts as both prosecutor and judge. The only procedural barrier preventing public asset liquidation is a well-founded brief of statutory exceptions under Article 831 of the Tax Statute, filed within 15 business days of service. DIAN has one month to rule (Article 832); if denied, the sole administrative appeal is reconsideration (reposición) under Article 834. Ligal unites ex-DIAN administrative experience with certified accounting depth to defend assets and structure compliant payment terms.

Are your bank accounts already frozen? We simultaneously petition for seizure release or reduction under Article 838.

Frequently Asked Questions

DIAN Payment Orders, Clearly Answered

It is the formal administrative decree whereby DIAN commences enforced administrative collection (Article 826 of the Tax Statute). It coercively commands the debtor to settle outstanding liabilities stemming from Article 828 executive titles (tax returns, final official assessments, or penalty resolutions), plus inflation updates and statutory default interest.

The taxpayer has exactly fifteen (15) business days following official notification to either pay the claimed amount or submit written statutory exceptions (Article 830 of the Tax Statute). Missing this deadline forfeits defense rights in administrative collection.

Exceptions are strictly limited to the closed list in Article 831 of the Tax Statute: 1. Full payment; 2. Existing payment agreement; 3. Lack of enforceability of the title; 4. Loss of enforceability due to revocation or judicial stay; 5. Statute of limitations on collection (Article 817); 6. Lack of an executive title or incompetence of the issuing official; 7. Improper joint debtor designation. No other exceptions are admitted.

No. If the debt originates from a tax return or a final, unappealed official assessment, the payment order stage cannot be used to reopen substantive tax arguments. Collection defenses are confined exclusively to Article 831 exceptions.

If 15 business days elapse without payment or exceptions, DIAN must issue a mandatory resolution ordering execution to proceed and asset auctions to be scheduled (Article 836 of the Tax Statute). This triggers asset seizures, bank freezes, and public liquidation.

DIAN has one month to resolve exceptions via an administrative resolution (Article 832). If denied, the sole administrative remedy is an appeal for reconsideration (recurso de reposición) filed within one month (Article 834), exhausting administrative remedies.
