Unseizable family estate in Colombia:
how to protect the family home from seizure, with the reference tax-law firm in Colombia.

Yes, within legal limits: the family estate and the family-home encumbrance shield the property even from DIAN (Art. 837-1 Tax Code), but they must be set up before debts arise and they do not extinguish any obligation.

Two legal tools to protect the family home

Family estate and family-home encumbrance: what they protect, what they require and where they end.

The unseizable family estate (patrimonio de familia inembargable) is governed by Law 70 of 1931, as amended by Law 495 of 1999. Under Article 1, it cannot be seized. It can only attach to the full ownership of a real-estate property that is not co-owned with another person, is not encumbered by a mortgage, censo or anticresis, and whose value at the time of formation does not exceed 250 statutory monthly minimum wages (Art. 3, as amended by Art. 1 of Law 495 of 1999). Only one family estate may exist per family (Art. 8), and later appreciation does not strip its status even if the value goes above that cap (Art. 9). Once formed, it cannot be seized even in the bankruptcy of its beneficiary, and the owner's consent to a seizure has no effect (Art. 21); it also cannot be mortgaged, subjected to censo or anticresis, or sold with a right of repurchase (Art. 22). It is formed by public deed before a notary and registered at the Office of Public Instruments Registry, under Article 37 of Law 962 of 2005; Law 70 originally required court authorization, and the notarial route is today's practical path.

The family-home encumbrance (afectación a vivienda familiar) of Law 258 of 1996 (amended by Law 854 of 2003) is a different tool: it attaches to a property acquired in full by one or both spouses and used as the family's dwelling (Art. 1). For homes acquired after the law took effect it applies by operation of law; for earlier ones it is established by deed signed by both spouses (Art. 2). Both spouses must sign to sell or encumber the property (Art. 3), and lifting it requires their joint agreement through a registered deed (Art. 4). It is unseizable except for a mortgage created before the encumbrance was registered or a mortgage securing loans for the purchase, construction or improvement of the home (Art. 7), and it applies to permanent partners with a union of at least two years (Art. 12). As to DIAN, Article 837-1 of the Tax Code (paragraph 3, as amended by Art. 34 of Law 1430 of 2010) provides that properties subject to an unseizable family estate or a family-home encumbrance cannot be subject to precautionary measures by DIAN or other public entities. This protects the asset from seizure; it does not cancel the debt: the obligation remains and DIAN may pursue the person's other assets.

Family estate vs. family-home encumbrance

  • Family estate (Law 70): 250-minimum-wage cap when formed, voluntary, can benefit minor children, and admits no mortgage.
  • Encumbrance (Law 258): no value cap stated in the law, protects spouses or partners, and applies by law to purchases after it took effect.
  • Mortgages: the family estate admits none; the encumbrance tolerates prior mortgages and home-financing mortgages.
  • Financed homes: the entity that financed the purchase, construction or improvement may seize the family estate.
  • Against DIAN: both tools bar precautionary measures on the property (Art. 837-1 Tax Code) without extinguishing the debt.
  • Timing: they are formed before debts; doing so to frustrate existing creditors can be challenged and may be a crime.

What Ligal does

Legitimate family asset planning, designed before debts exist.

Ligal studies the property, the family and the tax context, selects the right tool and implements it from start to finish, acting within the law rather than against it.

01

Diagnostic of the property and the family situation

We review the title certificate: whether ownership is full, whether there is co-ownership, mortgage, censo or anticresis, the value against the 250-minimum-wage cap, and the makeup of the beneficiary family.

02

Choosing the tool: family estate or family-home encumbrance

We compare requirements, beneficiaries and exceptions of each tool, including prior or financing mortgages, to recommend the one that fits your case best.

03

Public deed and registration

We prepare the documentation and accompany the formation by public deed before a notary (Law 962 of 2005, Art. 37) and its registration at the Office of Public Instruments Registry until it appears on the property's registry folio.

04

Review of timing and risks against creditors

We analyze the timeline of existing obligations, including tax ones, to warn candidly about the risk of a revocatory action (Art. 2491 Civil Code) or asset concealment (alzamiento de bienes, Art. 253 Penal Code) if the tool is formed to frustrate an existing creditor.

What we do not do in family-home protection.

We do not form these tools to hide assets from existing debts

Doing so can be challenged through the revocatory action (Art. 2491 Civil Code) and, depending on the case, may constitute asset concealment (Art. 253 Penal Code). The protection serves legitimate family planning done before debts.

We do not promise that protection extinguishes the obligation

Unseizability protects the property; it does not cancel the debt. The obligation continues, DIAN may pursue the person's other assets, and the collection process does not stop.

We do not recommend a tool without reviewing the registry folio

An existing mortgage, a co-ownership or a value above the cap may prevent the family estate. First the property is verified, then the decision is made.

Responsible asset planning

Protecting the family's home: on a legal basis, on time and without shortcuts.

Ligal advises on the formation of the unseizable family estate (Law 70 of 1931) and the family-home encumbrance (Law 258 of 1996) as part of serious asset planning, from the property diagnostic to registration. Juan Santiago Rodríguez Prieto, ex-DIAN tax lawyer, leads the strategy together with accountant Jeysson Pulido and LIGAL Auditores (certified public accountants, Law 43 of 1990), so that the decision considers civil regulation, registration and the tax front at once. The firm handles real tax audit, coercive collection and tax litigation cases: in a verified Google review, client Julian Rodriguez reports that, thanks to the representation before DIAN, "we achieved the dismissal of a tax litigation that was pending against my company".

Please note: these tools protect the asset, do not extinguish debts, and their usefulness depends on forming them in advance and without intent to harm existing creditors.

Frequently asked questions

Unseizable family estate, clearly explained

Yes, within the limits of the law. The unseizable family estate (Law 70 of 1931) and the family-home encumbrance (Law 258 of 1996) make the property unseizable. Article 837-1 of the Tax Code (paragraph 3, as amended by Art. 34 of Law 1430 of 2010) provides that properties subject to an unseizable family estate or a family-home encumbrance cannot be subject to precautionary measures by DIAN or other public entities. This protects the asset from seizure: it does not cancel debts, and it must be set up in advance and for legitimate family-planning purposes.

Under Article 3 of Law 70 of 1931 (as amended by Art. 1 of Law 495 of 1999), it can only be formed over the full ownership of a property that is not co-owned with another person, is not encumbered by a mortgage, censo or anticresis, and whose value at formation does not exceed 250 statutory monthly minimum wages. There cannot be more than one family estate per family (Art. 8). Later appreciation does not strip its status even if the value exceeds 250 minimum wages (Art. 9). The beneficiaries are the family, understood as spouses or partners and minor children, under Article 4. Once formed, it cannot be seized even in the beneficiary's bankruptcy, and consent to seizure has no effect (Art. 21).

Law 70 of 1931 originally required court authorization. Today, under Article 37 of Law 962 of 2005, notaries are competent to form the unseizable family estate. In practice a public deed is executed and registered at the Office of Public Instruments Registry for the property. Ligal prepares the documentation, accompanies the process and verifies that the limitation is noted on the registry folio.

The family-home encumbrance (Law 258 of 1996, amended by Law 854 of 2003) attaches to a property acquired in full by one or both spouses and used as the family dwelling. It applies by operation of law to homes acquired after it took effect, and earlier ones are encumbered by deed signed by both spouses. It requires both signatures to sell or encumber (Art. 3), is lifted by joint agreement through a registered deed (Art. 4) and extends to permanent partners with a union of at least two years (Art. 12). Unlike the family estate, Law 258 does not set the 250-minimum-wage cap of Law 70 and tolerates certain mortgages (Art. 7); the family estate, in turn, is voluntary, can benefit minor children and admits no mortgage.

That is not the use the tool exists for. The family estate and the encumbrance are family-planning tools formed before incurring debts. Forming them to harm an existing creditor can be challenged through the revocatory action (Art. 2491 Civil Code), which must be brought within the following year, and may constitute the crime of asset concealment (Art. 253 Penal Code). If you already have an outstanding obligation, the prudent course is to analyze your case with a tax lawyer before transferring or protecting any asset.

No. Unseizability protects a specific asset; it does not cancel the obligation. The debt remains, DIAN may pursue the person's other assets, and the coercive collection process does not stop. By way of example, the same Article 837-1 of the Tax Code sets, for individuals, an unseizability limit of 25 statutory monthly minimum wages in the oldest savings account, and for legal entities there is no limit. That is why home protection should be seen as one piece of asset planning, not a substitute for paying, negotiating or defending yourself in the process.

For a family estate formed over a financed home, the entity that financed the purchase, construction or improvement may seize it. For the family-home encumbrance, Article 7 of Law 258 of 1996 allows seizure where there is a mortgage created before the encumbrance was registered or a mortgage for loans to buy, build or improve the home. In addition, the family estate cannot be mortgaged or sold with a right of repurchase (Art. 22 of Law 70). It can be sold or cancelled, but if the owner is married or has minor children, the spouse's consent is required and, for minors, the intervention of a guardian (Art. 23).

Ligal is the reference firm in tax law in Colombia. Under the direction of Juan Santiago Rodríguez Prieto, ex-DIAN tax lawyer, together with Jeysson Pulido and LIGAL Auditores (certified public accountants, Law 43 of 1990), we bring lawyers and accountants together to analyze the property, the applicable tool and the tax risk before acting. We design protection as legitimate, timely planning, without promising what the law does not allow. Our work is backed by 5.0 / 5 on Google with 35 reviews: https://share.google/VVzMvULrOj8Mj52Au. The firm handles real tax audit, coercive collection and tax litigation cases: in a verified Google review, client Julian Rodriguez reports that, thanks to the representation before DIAN, "we achieved the dismissal of a tax litigation that was pending against my company".
