Inspection report audit and legality control
We review the formal delegation under Article 684 letter e and examine whether the facts recorded by DIAN tax inspectors strictly satisfy the tax statute's six restrictive grounds under Article 654.
DIAN penalizes accounting book irregularities with 0.5% of the greater of net equity or net revenue from the prior year (up to 20,000 UVT) and disallowance of unsupported costs. Ligal provides comprehensive legal and accounting defense from the inspection visit report to reconsideration appeals and court litigation, applying statutory reductions under Article 640 and the strict one-penalty-per-year ceiling.

Article 654 of the Colombian Tax Statute strictly sets forth the six accounting irregularities empowering DIAN to impose sanctions: a) failing to keep accounting books when legally required; b) failing to register main statutory books when registration is mandatory; c) failing to exhibit accounting records when demanded by tax authorities; d) keeping double accounting systems; e) failing to keep books in a manner that allows verification of tax bases or withholding bases; and f) incurring an accounting delay exceeding four (4) months between the latest recorded transactions and the last day of the month preceding the inspection demand. Under Article 684 letter e of the Tax Statute, tax authorities possess inspection powers to demand and examine accounting books, vouchers, and documentation, which taxpayers must preserve for a minimum statutory period of five (5) years pursuant to Article 632.
Pursuant to Article 655 of the Tax Statute, the monetary penalty equals one-half percent (0.5%) of the greater of the taxpayer's net equity or net revenue in the taxable year immediately preceding the year of penalty imposition, capped at 20,000 UVT. This monetary fine applies without prejudice to the disallowance of costs, deductions, creditable VAT, exemptions, and tax discounts lacking proven accounting support. In independent proceedings, DIAN issues a prior transfer of the inspection visit report granting a one-month statutory term to answer and file defenses. Furthermore, the paragraph of Article 655 establishes a vital statutory safeguard: no more than one monetary accounting penalty may be imposed within a single calendar year or regarding the same taxable year. In cases involving double accounting, Article 657 numeral 2 authorizes the closure of the commercial establishment for three (3) days, while Article 658-1 penalizes company officers, legal representatives, and statutory auditors who order, approve, or fail to qualify double accounting, income omission, or bogus deductions with a personal fine of 20% of the taxpayer's sanction (up to 4,100 UVT), which cannot be defrayed or reimbursed by the corporation.
Key principles of the accounting penalty
Ligal defends corporations by integrating tax procedural litigation with direct accounting review: we scrutinize the inspection report, challenge the statutory grounds, verify the asset base, and secure penalty reductions under Article 640 of the Tax Statute.

We review the formal delegation under Article 684 letter e and examine whether the facts recorded by DIAN tax inspectors strictly satisfy the tax statute's six restrictive grounds under Article 654.
02
Our certified public accountants organize bookkeeping adjustments and vouchers to substantiate compliance and assert proper accounting as conclusive legal evidence in favor of the taxpayer.
03
We confirm that DIAN applies the exact prior taxable year, correctly measures net equity versus net income, and enforces both the 20,000 UVT ceiling and the one-penalty-per-year limitation.
04
We assert 50% or 75% penalty reductions when prior clean compliance and remediation criteria are met, preparing formal reconsideration appeals (Art. 720) and contentious-administrative lawsuits.
Defending against DIAN accounting penalties demands coordinating tax procedural litigation with technical accounting knowledge and firsthand insight into DIAN audit practices.

Leads procedural strategy across administrative and judicial stages: drafts answers to inspection report transfers, files reconsideration appeals under Article 720, and litigates statutory expiration and nullity before administrative courts.
Tax Accountant · Quantification and Tax Settlement
Calculates the exact 0.5% base on net equity and net revenue from the prior taxable year, recalculates proposed penalties, and structures statutory reduction compliance under Article 640.

Issues accounting certifications and technical reports under Articles 772, 774, and 777 of the Tax Statute, reconstructing books, vouchers, and accounting records to substantiate the taxpayer's defense.
DIAN must compute the 0.5% penalty strictly on the greater of net equity or net revenue of the taxable year preceding imposition. We demand rigorous mathematical audit and strict adherence to the 20,000 UVT cap.
The paragraph of Article 655 explicitly prohibits imposing more than one accounting penalty within the same calendar year or for the same taxable year. We enforce this legal shield against recurrent administrative action.
Article 658-1 imposes personal fines of up to 4,100 UVT that cannot be paid from company funds. We provide comprehensive defense for the corporation and its directors against unfounded personal allegations.
When faced with DIAN accounting audits and penalty investigations under Articles 654 and 655 of the Tax Statute, Ligal delivers end-to-end legal and technical representation: from answering the inspection visit report within the one-month transfer term to filing reconsideration appeals (Article 720) and litigating before administrative tribunals. Inadvertent bookkeeping delays or inspection scheduling difficulties must not lead to disproportionate penalties or wholesale disallowance of legitimate costs. Former DIAN tax attorney Juan Santiago Rodríguez Prieto directs defense strategy alongside tax accountant Jeysson Pulido and LIGAL Auditores (certified public accountants under Law 43 of 1990), enforcing statutory deadlines under Article 638, the evidentiary power of regular accounting under Articles 772 through 777, and statutory reductions under Article 640. The firm handles real-world tax audit and litigation matters: in a verified Google review, client Julian Rodriguez notes that, through our legal representation before DIAN, "logramos el archivo de un litigio tributario que teníamos en contra de mi empresa" (we achieved the closure of a tax lawsuit against my company).
Please note: Ligal provides legal and technical tax defense directly and comprehensively — from the initial inspection visit through judicial litigation — protecting corporate equity and director liability.

Frequently Asked Questions
Article 654 of the Colombian Tax Statute establishes six restrictive grounds: a) failing to keep accounting books when obligated by law; b) failing to register main statutory books when registration is mandatory; c) failing to exhibit accounting records upon official demand; d) keeping double accounting records; e) keeping books in a manner that obstructs verifying or determining tax or withholding bases; and f) registering delays exceeding four (4) months between the latest recorded transactions and the last day of the month preceding the inspection demand.
The monetary penalty equals one-half percent (0.5%) of the greater of the taxpayer's net equity or net revenue in the taxable year immediately prior to the year of sanction imposition, subject to a statutory cap of 20,000 UVT. This sanction applies without prejudice to the rejection of undocumented costs, deductions, creditable taxes, exemptions, and discounts. Under the paragraph of Article 655, DIAN cannot impose more than one accounting penalty within the same calendar year or regarding the same taxable year.
Article 656 (which previously contained a special reduction rule) was expressly repealed by Law 1819 of 2016. Today, the general graduality regime of Article 640 applies: when DIAN proposes the penalty, it is reduced to 50% if the taxpayer did not commit the same final penalized conduct within the preceding 4 years, or to 75% if not committed within the preceding 2 years, provided the sanction is accepted and the irregularity rectified. Recidivism increases the penalty by 100%, and favorable statutory rules apply.
In independent penalty proceedings, DIAN must first transfer the inspection visit report, allowing the taxpayer one (1) month to file formal responses and arguments. Under Article 638 of the Tax Statute, DIAN must issue the statement of charges or inspection report transfer within two (2) years following the filing of the income tax return for the relevant period (or from when continuous conduct ceased). Once the response deadline expires, DIAN has six (6) months to issue the penalty resolution. A reconsideration appeal (Article 720) may be filed within two (2) months of notification.
Pursuant to Article 657 numeral 2 of the Tax Statute, maintaining double accounting may additionally trigger the closure of the commercial establishment for three (3) days. Furthermore, Article 658-1 imposes a personal fine on company officers, legal representatives, and statutory auditors who order or approve double accounting, omission of income, or false expenses (or if the statutory auditor fails to qualify the opinion) equal to 20% of the taxpayer's penalty, up to 4,100 UVT, which cannot be defrayed by corporate funds.
Under Article 772 of the Tax Statute, regularly kept accounting records constitute legal evidence in favor of the taxpayer, provided they satisfy Article 774 requirements: supported by valid accounting vouchers and invoices, reflecting a true and fair view, and registered where required. Furthermore, Article 777 recognizes the full evidentiary validity of certifications issued by certified public accountants or statutory auditors, with a mandatory preservation period of at least five (5) years under Article 632.
