Legal Framework of Article 658-3 of the Tax Code

Penalties relating to the RUT: four conducts, fines in UVT and closure of the establishment.

Article 658-3 of the Colombian Tax Code (added by Article 49 of Law 1111 of 2006) governs penalties relating to the Single Tax Registry (RUT). Numeral 1 penalizes failing to register in the RUT before starting the activity when obliged to do so: closure of the establishment, headquarters, premises, business or office for one (1) day for each month or fraction of a month of delay in registering, or a fine of 1 UVT for each day of delay for those who have no establishment, headquarters, premises, business or office. Numeral 3 penalizes failing to update information within the month following the event that requires the update, with a fine of 1 UVT for each day of delay; if the outdated item is the address or the economic activity, the fine is 2 UVT for each day of delay. Numeral 4 penalizes reporting false, incomplete or mistaken data in the RUT, by someone registered or obliged to register, with a fine of 100 UVT. Numeral 2, designed for the former simplified VAT regime, referred to failing to display the registration certificate in a place visible to the public (fine of 10 UVT and closure for 3 days) and today has a limited scope.

Article 631-6 of the Tax Code provides that the Single Registry of Beneficial Owners (RUB) is part of the RUT: failing to provide, providing erroneously or incompletely, or failing to update beneficial owner information is penalized under Article 658-3. As to the amount, Article 639 establishes that the 10 UVT minimum penalty does not apply to the penalties of numerals 1 and 3 of Article 658-3, so they may be lower than 10 UVT. Article 640 provides reductions of the penalty to 50% or 75% (graduated reduction) depending on recidivism and on whether the taxpayer accepts the penalty and cures the breach; recidivism, in turn, increases the penalty by 100%, and paragraph 3 excludes proportionality and graduation for numeral 4 (false data). As for procedure, when the penalty is imposed by a separate resolution, Article 638 requires the statement of charges to be issued within two (2) years following the filing of the income tax return for the period in which the irregularity occurred or ceased, and once the response period has expired, the DIAN has six (6) months to impose the penalty.

What Ligal does

Defense before the DIAN against RUT penalties, reviewing facts, dates and the numeral applied.

Ligal analyzes the statement of charges or the resolution, reconstructs the RUT history and prepares the response with evidence, with lawyers and accountants on a single team.

01

Verifying the actual date of the event

We establish when the activity actually began or when the change requiring a RUT update occurred, because the computation of the delay depends on that date.

02

Counting days and months of delay

We check that the days of delay for the fine, or the months and fractions for the closure, are correctly counted and that the right numeral of Article 658-3 was applied.

03

Procedural deadlines and limitations

We examine whether the statement of charges was issued within the period of Article 638 of the Tax Code and whether the penalty was imposed within six months after the response period expired.

04

Graduated reduction and evidence-based response

Where applicable, we assess the graduated reduction under Article 640 and prepare the response to the statement of charges with documentary and accounting support, and the appeals that may follow.

Professional standards

What we do not do in RUT penalty cases.

We do not promise outcomes

The outcome depends on the facts, the evidence and the procedure. We tell you clearly what arguments your case has and what the risks are.

We do not accept the numeral applied without reviewing it

The conducts in Article 658-3 carry different penalties and graduation rules. We check that the DIAN placed the conduct under the correct numeral.

We do not let deadlines pass

The statement of charges has a response period and the DIAN's action has time limits. We monitor both from day one.

Specialized legal defense

RUT penalties: correct data, proven dates and a reviewed procedure.

A RUT penalty may seem minor, but its effect goes beyond the fine: the address and email in the RUT are those used for notification (Articles 563 and 565, paragraph 1, of the Tax Code), so an outdated RUT can lead a taxpayer to miss DIAN acts. In addition, a correct RUT is necessary to issue electronic invoices. Juan Santiago Rodríguez Prieto, an ex-DIAN tax lawyer, leads the defense together with accountant Jeysson Pulido and LIGAL Auditores (certified public accountants, Law 43 of 1990). The firm handles real audit and tax litigation cases: in a verified Google review, client Julian Rodriguez shares that, thanks to representation before DIAN, "we achieved the closure of a tax lawsuit pending against my company".

Please note: the response to the statement of charges has a legal deadline. If you have already received one, do not wait to consult us.

Frequently asked questions

RUT penalties, clearly explained

Article 658-3 of the Colombian Tax Code (added by Article 49 of Law 1111 of 2006) penalizes four conducts: (1) failing to register in the RUT before starting the activity when obliged to do so; (2) failing to display the registration certificate in a place visible to the public, a scenario designed for the former simplified VAT regime; (3) failing to update information within the month following the event that requires the update; and (4) reporting false, incomplete or mistaken data in the RUT, when registered or obliged to register.

Under numeral 1 of Article 658-3, anyone obliged to register who does not do so before starting the activity is penalized with closure of the establishment, headquarters, premises, business or office for one (1) day for each month or fraction of a month of delay in registering. For those who have no establishment, headquarters, premises, business or office, the penalty is a fine of 1 UVT for each day of delay.

Numeral 3 of Article 658-3 penalizes failing to update information within the month following the event that requires the update, with a fine of 1 UVT for each day of delay. If the outdated information is the address or the economic activity, the fine is 2 UVT for each day of delay. In addition, because the address and email in the RUT are used for notification, keeping them outdated can lead you to miss DIAN acts.

Numeral 4 of Article 658-3 imposes a fine of 100 UVT on anyone who, being registered or obliged to register, reports false, incomplete or mistaken data in the RUT. Proportionality and graduation do not apply to this penalty (Article 640, paragraph 3, of the Tax Code).

Article 631-6 of the Tax Code establishes that the Single Registry of Beneficial Owners (RUB) is part of the RUT. Failing to provide beneficial owner information, providing it erroneously or incompletely, or failing to update it is penalized under Article 658-3.

Under Article 639 of the Tax Code, the 10 UVT minimum penalty does not apply to the penalties of numerals 1 and 3 of Article 658-3. For that reason, the fine for failing to register or to update may be lower than 10 UVT, depending on the days of delay.

Article 640 of the Tax Code provides reductions to 50% or 75% (graduated reduction) depending on recidivism and on whether the penalty is accepted and the conduct cured. Recidivism increases the penalty by 100%. Paragraph 3 of the same article excludes proportionality and graduation for numeral 4 of Article 658-3 (false data). Eligibility depends on each case.

When the penalty is imposed by a separate resolution, Article 638 of the Tax Code requires the statement of charges to be issued within two (2) years following the filing of the income tax return for the period in which the irregularity occurred or ceased. Once the response period to the statement of charges has expired, the DIAN has six (6) months to impose the penalty. Verifying these deadlines is part of the defense.
