Legal Framework of Articles 652, 652-1, 653, and 657 of the Tax Statute

Electronic invoicing infractions: financial penalties, establishment closure, and evidentiary weight of inspection minutes.

The Colombian tax sanctioning regime strictly distinguishes between issuing invoices that omit formal requirements and failing to invoice altogether. Under Article 652 of the Colombian Tax Statute (E.T.), any person or entity obliged to invoice who does so without the requirements of items a), h), and i) of Article 617 E.T. (express denomination as a sales invoice, software developer identification, and statement of VAT withholding agent status, as well as omitting the tax ID / NIT under its paragraph) faces a monetary penalty of 1% of the value of transactions billed without such requirements, capped at 950 UVT. Repeat violations trigger the establishment closure sanction regulated in Article 657 E.T. Furthermore, Article 652-1 E.T. establishes that failure to issue an invoice or equivalent document when legally required leads directly to the closure sanction set forth in Articles 657 and 658 E.T.

The closure sanction in Article 657 E.T. is enforced for 3 days under Numeral 1 when an invoice or equivalent document is not issued, or when it is issued lacking the requirements of items b), c), d), e), f), or g) of Article 617 E.T., or upon repeat non-compliance with items a), h), or i). A 3-day closure also applies under Numeral 2 for revenue suppression systems, double billing, or unrecorded invoices, and under Numeral 5 for failing to adopt or breaching technical control systems prescribed by DIAN (Article 684-2 E.T.). The proceeding requires an advance statement of charges granting the taxpayer a strict 10-day term to respond. Closure becomes enforceable only within 10 days following the exhaustion of administrative remedies. Under Paragraph 6 of Article 657, the taxpayer may opt to pay a substitute fine (5% of operational revenue of the preceding month for Numeral 1, and 10% for Numerals 2 and 5) to prevent physical closure. Against the closure resolution, a reconsideration appeal under Article 735 E.T. may be filed within 10 days. Additionally, Article 653 E.T. mandates that failure to invoice or issuance without requirements must be recorded in an inspection minute signed by two commissioned DIAN officers; in subsequent administrative or judicial discussions, no explanations differing from those recorded in the minute may be adduced, making initial statements during the visit critically decisive.

Legal Defense & Technical Accounting Audit

Evidentiary defense before DIAN, inspection minute review, and charges resolution.

Ligal coordinates procedural dispute management with deep technical auditing of electronic invoicing systems: we examine the initial inspection minute, challenge statutory requirement classifications under Article 617, and evaluate whether to litigate or apply for the substitute fine.

01

Rigorous Audit of the Inspection Minute (Art. 653 E.T.)

We scrutinize the minute drafted by the two DIAN officers to verify adherence to due process and reconcile recorded statements against actual issuance data.

02

Validation & Delivery Technical Verification (CUFE)

We audit DIAN prior-validation events, Electronic Invoice Unique Code (CUFE) logs, and buyer delivery acknowledgments under Article 616-1 of the Tax Statute.

03

Defense Filing Within the 10-Day Statutory Window

We draft formal technical defenses addressing statutory classification between Article 652 (1% fine) and Article 657 (closure), proving compliance with legal requirements.

04

Substitute Fine Modeling & Reconsideration Appeal

We calculate the financial impact of the substitute fine under Paragraph 6 of Article 657 E.T. versus filing a reconsideration appeal under Article 735 E.T.

Professional Standards

What we do not do in electronic invoicing disputes.

We do not miss the 10-day statutory response deadline

The timeframe provided in Article 652 and Paragraph 2 of Article 657 E.T. is strictly preclusive. Missing this window forfeits the right to contest allegations or request the substitute fine.

We do not disregard evidentiary limits under Article 653 E.T.

The statute forbids raising explanations differing from those written in the initial inspection minute. We avoid contradictory arguments, anchoring defense on verified technical and documentary evidence.

We do not claim Article 640 reductions where legally prohibited

Paragraph 3 of Article 640 E.T. expressly excludes gradualism and proportional reductions for Article 652-1 and Numerals 1, 2, and 3 of Article 657 E.T. Our defense strictly abides by statutory boundaries.

Specialized Legal Practice

Electronic invoicing legal defense: rigorous procedural representation against DIAN audits and closure orders.

Faced with audit inspections, non-issuance minutes, and sanction resolutions under Articles 652, 652-1, and 657 of the Tax Statute, Ligal delivers comprehensive legal and accounting defense. Juan Santiago Rodríguez Prieto, former DIAN tax attorney, directs procedural defense alongside accountant Jeysson Pulido and LIGAL Auditores (certified public accountants under Law 43 of 1990) to examine alleged omissions under Article 617 E.T., verify electronic transmission and CUFE validation under Article 616-1 E.T. and DIAN Resolution 000165 of 2023, and respond within the mandatory 10-day window. We evaluate whether to challenge charges through a reconsideration appeal under Article 735 E.T. or request the substitute fine under Paragraph 6 of Article 657 E.T. to keep business doors open. The firm handles real tax audits and litigation: in a verified Google review, client Julian Rodriguez notes that, through representation before DIAN, "we achieved the closure of a tax dispute that was brought against my company".

Please note: an electronic invoice is only deemed legally issued once validated by DIAN and delivered to the recipient (Art. 616-1 E.T.); POS cash register receipts do not support tax costs, deductions, or creditable VAT (Art. 771-2 E.T.).

Frequently Asked Questions

DIAN electronic invoicing penalties explained clearly

The Colombian Tax Statute establishes two primary penalty mechanisms: Article 652 imposes a monetary penalty of 1% of the value of transactions billed without meeting the requirements of items a), h), and i) of Article 617 E.T. (invoice denomination, software developer/printer identification, and VAT withholding agent status, plus NIT under its paragraph), capped at 950 UVT, with repeat offenses leading to closure. In addition, Article 652-1 and Article 657 Numeral 1 mandate a three (3) day establishment closure when failing to issue an invoice or equivalent document when legally required, or issuing invoices omitting requirements under items b), c), d), e), f), or g) of Article 617 E.T.

Article 653 of the Tax Statute provides that failure to invoice or issuing invoices without legal requirements is recorded on-site in a minute signed by two commissioned DIAN officers. Critically, during subsequent administrative or judicial discussions, the taxpayer cannot present explanations differing from those recorded in that minute. As a result, statements and facts documented during the initial inspection visit are decisive for all subsequent defense arguments.

For both the monetary penalty under Article 652 and the closure sanction under Article 657 (Paragraph 2) of the Tax Statute, DIAN must issue a prior statement of charges granting the taxpayer a strict ten (10) day term to formulate defenses and submit or request evidence. The closure sanction only becomes enforceable within ten (10) days after administrative remedies have been fully exhausted.

Paragraph 6 of Article 657 of the Tax Statute enables a taxpayer facing establishment closure to pay a financial fine instead of having physical closure seals placed. This substitute fine equals 5% of operational revenue from the month preceding the infraction for Numeral 1 (failure to invoice or omitting items b through g), or 10% for Numerals 2 (revenue suppression or double billing) and 5 (technical control systems). Timely payment prevents the physical closure of the commercial premises.

No. While Article 640 of the Tax Statute offers 50% or 75% penalty reductions when an infraction is accepted and remedied with a clean compliance history over the preceding two or four years, Paragraph 3 of Article 640 expressly forbids applying this gradualism to penalties under Article 652-1 and Numerals 1, 2, and 3 of Article 657 E.T.

Pursuant to Article 616-1 of the Tax Statute, an electronic invoice is only deemed issued once it has been validated in advance by DIAN and delivered to the acquirer. Delivery without prior validation does not satisfy the statutory obligation to invoice. Regulatory rules are compiled in DIAN Resolution 000165 of 2023. Additionally, for costs, deductions, or creditable VAT to be accepted, Article 771-2 E.T. mandates valid sales invoices; POS cash register tickets do not confer rights to tax costs, deductions, or creditable VAT.

Under Article 735 of the Tax Statute, the sole legal remedy against a resolution ordering establishment closure is a reconsideration appeal (recurso de reposición). It must be filed within ten (10) days following formal notification and must be resolved within ten (10) days. This appeal suspends the enforcement of the closure until administrative resolution is formally reached.
